Agreement to Terms. Your access to and use of https://fencecontractorkirklin.com is conditioned on your acceptance of and compliance with these Terms. By using the Site, you agree to these Terms in full.
Service Description. This Site describes Wrought Iron Fences, Cantilever Gates, Custom Fences, Aluminum Fences, Wood Fencing, Vinyl Privacy Fence, Swing Gates, Pedestrian Gates provided by APEX FENCE. Estimates and quotes are issued separately and superseded by signed agreements.
Account Conduct. Information you provide must be accurate. You must keep any login credentials private and report unauthorized use immediately.
Use Restrictions. Prohibited activities include unlawful use, disruption of services, unauthorized access, automated scraping, malware transmission, and impersonation.
Ownership. APEX FENCE (or its licensors) owns all Site content, including text, images, branding, and code. Reproduction without consent is prohibited.
Payment Terms. Pricing is communicated in writing prior to engagement. Refund eligibility, if any, is set in your service agreement.
Account Closure. APEX FENCE reserves the right to deny or revoke Site access at any time, particularly upon violation of these Terms.
Service Disclaimer. The Site and its content are made available without warranties of any kind. APEX FENCE does not guarantee uninterrupted, error-free access.
Damages. APEX FENCE is not liable for indirect, incidental, special, consequential, or punitive damages. Aggregate liability shall not exceed amounts you paid us in the 12 months prior to the claim.
Indemnity. You agree to defend and indemnify APEX FENCE from claims, including reasonable attorney fees, that result from your use of the Site or breach of these Terms.
Applicable Law. These Terms are construed under IN law. The parties consent to venue and jurisdiction in IN for any related dispute.
Changes to Terms. We may update these Terms periodically. Changes are effective upon posting. Continued Site use after changes means you accept the revisions.
